EVOKE EXPERIENCES - BOOKING TERMS & CONDITIONS

Evoke Experiences aims to deliver experiences that clients will look forward to, enjoy and reflect on. Despite the fact that you are embarking on a carefree experience, there is still a serious side that we must address. The Evoke Experiences Terms and Conditions aim to enhance your overall experience by bringing your attention to the requirements of the booking, as well as your responsibilities as the Client. 

By booking a retreat, event or experience with Evoke Experiences you are agreeing to all of the included information and the Booking Terms and Conditions, which constitute the agreement between Evoke Experiences and yourself as the Client. 


Interpretation

  1. Evoke Experiences means Beyond Experiences Pty Ltd trading as Evoke Experiences and includes  our directors, employees, sub-contracted facilitators, agents and licensees.

  2. Client means the individual or group entity who books and pays for a retreat, event or experience through Evoke Experiences

  3. Facilitator means an individual engaged by Evoke Experiences to act as a guide throughout a retreat, event or experience

  4. Services means the supply of a Facilitator to provide their expertise in designing, planning and facilitating a retreat, ticketed event or experience, any associated supplies, documentation or items as agreed, in exchange for the fees charged by Evoke Experiences.

  5. Retreat, Event or Experience means a product outlined by Evoke Experiences and made available via www.evokeexperiences.com.au and receives payment for.

  6. Commencement Date means the first date of the retreat, event or experience

Booking Policy

  1. A booking is only secured when a minimum non-refundable 50% deposit is received via online payment via www.evokeexperiences.com.au or bank transfer

  2. By making payment of a deposit or full payment for any Evoke Experiences retreat, event or experience, you are accepting our full Terms and Conditions

  3. A Client must complete and submit a Retreat Attendee Form & Waiver to confirm their booking

 

Fees and Payments

  1. All prices are stated in Australian dollars and are inclusive of GST

  2. All payments must be made via www.evokeexperiences.com.au by credit card or via direct bank transfer

  3. A non-refundable 50% deposit is required to secure a Client's booking

  4. Payment in full is required 30 days prior to the commence date of the retreat, event or experience

  5. If the Client’s remaining balance is not paid prior to 30 days of the commencement date, Evoke Experiences reserves the rights to cancel the Client’s booking and retain the Client's deposit.

  6. The payment of any Optional Extras and/or Excluded Elements selected by the Client are the responsibility of the Client

Cancellation & Refunds 

  1. If a Client wishes to cancel their booking, the Client is required to notify Evoke Experiences in writing via Inspire@evokeexperiences.com.au

  2. 50% deposits are non-refundable

  3. A client’s deposit is transferable to another Evoke Experiences Service and is to be used within 6 months.

  4. If the Client has made payment in full,  50% of the full payment will be refunded if the Client notifies Evoke Experiences before 30 days prior to the commencement date of the Service

  5.  A cancelled booking can be transferred to another person and this transfer must be communicated to Evoke Experiences 14 days prior to the Service

  6.  If Evoke Experiences cancels or reschedules a retreat, event or experience for any reason, excluding force majeure events, you may transfer your full payment to another retreat, event or experience dated within a 12 month period, pending availability.  

  7. Evoke Experiences is not responsible for any expenses incurred in preparation of the cancelled retreat, including but not limited not, airfares, illness, relocation, loss of work.

  8. Evoke Experiences will not be liable or pay any compensation for cancellation, failure of, or delay in performing its obligations under this agreement due to force majeure events (earthquake, cyclone, fire, flooding, or other natural disasters, or in the case of war, action of foreign enemies, terrorist activities, labor dispute or strike, government sanction, blockage, embargo, pandemics or epidemic) or if certain conditions present unacceptable danger to the participant

  9. Evoke Experiences’ Services are all inclusive and credits or refunds for late arrival, early departure, not participating in or not accepting Service elements are not issued. 

  10. Refunds will be credited to the original payment method and any payment processing fees incurred by Evoke Experiences will be passed on to the Client. The exact original amount paid to Evoke Experiences will be refunded. 

 

Insurances 

1. The Client is responsible for obtaining their own comprehensive travel insurance for the booking period and duration of the retreat, event or experience booking. The insurance should include, but not be limited to, medical expenses and evacuation, trip cancellation and force majeure events.

 

Travel, passport & Visas 

  1. Evoke Experiences does not accept any responsibility should flights be missed by the Client.  Additional flight terms will be provided to the Client if Evoke Wellness Australia is required by the Client to arrange and book flights on behalf of the Client.

  2. It is the sole and absolute responsibility of the Client to ensure that passports and visas are valid for the countries visited by the Client for an Evoke Experiences retreat, event or experience.

 

Liability

  1. The Client and hereby releases and discharges to the full extent permitted by law Evoke Experiences from all claims and demands of every kind resulting from any loss, accident, damage, injury or death occurring to person or property in connection with, resulting from or incidental to the provision of the Services by Evoke Wellness Australia.  

  2. The Client expressly agrees that Evoke Experiences shall have no responsibility or liability for any loss of or damage to property or person and releases Evoke Experiences from any claim, action, demand, suit or proceeding by the Client therefore.

  3. You must consider your own safety and the safety of others when using the retreat space and any use by you within the retreat space is at your own risk. You should comply with any specific rules and security precautions relating to the retreat space communicated to you by our team or owners of the property.

  4. Use of the retreat, event or experience premises or partaking in any activities when under the influence of excessive alcohol or any drugs is strictly prohibited.

  5. Smoking is strictly prohibited in the retreat, event or experience space, which includes and is not limited to the bedrooms, common areas and property

Personal Health & Safety

  1. You must consider your own safety and the safety of others when using the retreat space and any use by you within the retreat space is at your own risk. You should comply with any specific rules and security precautions relating to the retreat space communicated to you by our team or owners of the property.

  2. The Client confirms they you are in sound mental and physical health and are unaware of any reason why they may be particularly unsuited to undertake in the activity agreed upon or may be likely to suffer illness or injury during the activity

  3. The Client must disclose all physical and mental health conditions in writing on their Retreat Attendee Form when booking a retreat, event or experience. Evoke Experiences reserves the right to withdraw the booking and remove the Client from the retreat, event or experience if there has been a failure to disclose correct information.

  4. If the Client partakes in any extra activities or services not offered by Evoke Experiences, the Client releases Evoke Experiences of any responsibility for any damages - financial, physical or otherwise - incurred in the undertaking of these activities. Contractual obligation lies directly between the Client and the activity supplier.


Privacy Policy & Media Indemnity

  1. The Client’s personal data which is obtained by Evoke Experiences is used only in relation to the retreat, event or experience which the Client booked. Evoke Wellness Australia assures that all personal data will be treated confidentially and not be transferred to any third parties other than necessary to fulfil the booking or deliver the requested Service.

  2. The Client provides Evoke Experiences with permission to use their collected data for internal market research purposes.

  3. The Client agrees that they may be photographed and/or filmed during their Evoke Experiences retreat, event or experience, and also agrees that Evoke Experiences may use such recordings for promotion and/or advertising purposes without any prior consent. If the customer wishes to not be photographed or photographs to be used on marketing material, they must select this option on the liability waiver and the Client’s privacy will be respected.


Governing  law  and  jurisdiction 

  1. This  agreement  and  all  questions  arising  in  connection  with  it  are  governed  by  and  will  be  construed according  to  the  laws  from  time  to  time  in  force  in  the  State  of  Queensland.  The  parties  irrevocably  submit  to the  authority  of  the  courts  having  jurisdiction  in  Queensland.
